ALWAYS talk to your parents.
Conversations are cool! It’s ok to involve your parents in all your online activities, show them your favorite sites. Share what you do online. And if you’re ever uncomfortable with something that happens online, don’t be afraid to let them know. It’s totally ok!
DON’T use your real name in your member name.
When you register, you create a memebr name and password to use on the site. Because anyone can see your screen name, don’t include your real name – or any numbers from your address or phone number. Instead, make up something new, creative, and fun! And never try to impersonate somebody else – that could get you banned from the site!
NEVER TELL anyone your password or personal info.
Never, ever share your password with anyone except your parents – it’s private! And don’t reveal your name, address, phone number, or email to anyone online. If someone asks for your info, tell them no. If they keep asking, keep saying no and let us know by clicking her character and selecting "report." Remember: No one from www.ndcsbuzz.org.uk will EVER ask for your password, so don’t give it out! Comments you make in our Cool Topics section will be viewed publicly; do not put personal information here.
NEVER ASK anyone for their password or personal info.
ALWAYS be nice!
Treat others the way you wanna be treated. Remember that every screen name has a real person behind it! We review comments and messages to make sure people are behaving, so make sure everything you chat about is friendly and safe.Never say anything hurtful or naughty – you could be banned from the site!
What do we mean when we say we will be marketing to you?
We will be sending you emails through the site, texts and by post if you have selected these options to tell you about the exciting activities in interesting information that we think you’d be interested in finding out about.

We check all of your comments in the Cool topics section before they go live, it may take a bit of time if there are many of them, so do bear with us.

(c) References to “Profile” are references to any profile you create during your use of the Site.

1. INFORMATION ABOUT US
www.ndcsbuzz.org.uk is a site operated by NDCS, National Deaf Children’s Society. We are registered in England and Wales under charity number 1016532 and have our registered office at 15 Dufferin Street, London, EC1Y 8UR.
2. ACCESSING THE SITE
2.1 If you are under [16] please check with your parent or guardian before using the Site.
2.2 Access to the Site is permitted on a temporary basis, and we reserve the right to withdraw or amend the service we provide on the Site without notice (see below). We will not be liable if for any reason the Site is unavailable at any time or for any period.
2.3 From time to time, we may restrict access to some parts of the Site, or our entire site, to users who have registered with us.
2.4 If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential, and you must not disclose it to any other person or organisation. We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our opinion you have failed to comply with any of the provisions of these terms of use.
2.5 You must keep your user name and password confidential at all times. Any breach of these terms of use by anyone to whom you disclose your password will be treated as if the breach had been committed by you, and will not relieve you of your obligations under these terms of use.
2.6 You must take appropriate security measures to prevent unauthorised disclosure of your user name and password and you must notify us immediately if you suspect that your password becomes known to any unauthorised user.
2.7 You are responsible for making all arrangements necessary for you to have access to the Site. You are also responsible for ensuring that all persons who access the Site through your internet connection are aware of these terms, and that they comply with them.
2.8 We do not guarantee that the functions or materials accessible from our or contained in the Site will be uninterrupted or error free, that defects will be corrected, or that the Site or the server that makes it available are free of viruses or faults.
3. INTELLECTUAL PROPERTY RIGHTS
3.1 We are the owner or the licensee of all intellectual property rights in the Site, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.
3.2 You may print off one copy, and may download extracts, of any page(s) from the Site for your personal reference and you may draw the attention of others to material posted on the Site.
3.3 You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.
3.4 Our status (and that of any identified contributors) as the authors of material on the Site must always be acknowledged.
3.5 You must not use any part of the materials on the Site for commercial purposes without obtaining written consent from us or our licensors. Please send any written requests to use content from the Site to [webteam@ndcs.org.uk].
3.6 If you print off, copy or download any part of the Site in breach of these terms of use, your right to use the Site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.
4. RELIANCE ON INFORMATION POSTED
Commentary and other materials posted on the Site are not intended to amount to advice on which reliance should be placed.
5. THE SITE CHANGES REGULARLY
We aim to update the Site regularly, and may change the content at any time. However, any of the material on the Site may be out of date at any given time, and we are under no obligation to update such material.
6. OUR LIABILITY
6.1 The material displayed on the Site is provided without any guarantees, conditions or warranties as to its accuracy. To the extent permitted by law, we, our affiliated organisations and third parties connected to us hereby expressly exclude:
6.1.1 all conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity;
6.1.2 any liability for any loss or damage whether direct, indirect or consequential incurred by any user in connection with the Site or in connection with the use, inability to use, or results of the use of the Site, any websites linked to it and any materials posted on it, including, without limitation, any liability for:
6.1.2.1 loss of income or revenue;
6.1.2.2 loss of business;
6.1.2.3 loss of profits or contracts;
6.1.2.4 loss of anticipated savings;
6.1.2.5 loss of data;
6.1.2.6 loss of goodwill;
6.1.2.7 wasted management or office time; and
6.1.2.8 for any other loss or damage of any kind, however arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable.
6.2 This does not affect our liability for death or personal injury arising from our negligence, nor our liability for fraudulent misrepresentation or misrepresentation as to a fundamental matter, nor any other liability which cannot be excluded or limited under applicable law.
6.3 Notwithstanding clause 6.1, if we are liable to you for any reason, our liability will be limited to £200. This limit does not apply to any liability we may have under Clause 6.2 above.
6.4 You are responsible for ensuring that your computer system meets all relevant technical specifications necessary to use the Site and is compatible with the Site. We do not guarantee that any material available from the Site will be free from infection, viruses and/or other code that has contaminating or destructive properties. You are responsible for implementing sufficient procedures and virus checks to satisfy your requirements.
6.5 You will indemnify NDCS against all proceedings, actions, damages, legal costs (including but not limited to legal costs and disbursements on a solicitor and client basis) expenses and any other liabilities arising from the use by NDCS of any content you post to the Site or any material sent in connection to the Site which involves any infringement or alleged infringement of the rights (including rights of privacy or publicity) or any other person, or which breaches any of the provisions of the terms or use.
7. PROHIBITED USES
7.1 You may use the Site only for lawful purposes. You may not use the Site:
7.1.1 in any way that breaches any applicable local, national or international law or regulation;
7.1.2 in any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect;
7.1.3 in any way which harms or has significant risk of harming children or vulnerable adults in any way;
7.1.4 to send, knowingly receive, upload, download, use or re-use any material which does not comply with our content standards below;
7.1.5 to transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam); or
7.1.6 to knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware.
7.2 You also agree:
7.2.1 not to reproduce, duplicate, copy or re-sell any part of the Site in contravention of the provisions of our terms of website use;
7.2.2 not to access without authority, interfere with, alter, damage or disrupt:
(a) any part of the Site;
(b) any equipment (including telecommunications equipment) or network on which the Site is stored;
(c) any software used in the provision of the Site; or
(d) any equipment or network or software owned or used by any third party.
8. INTERACTIVE SERVICES
8.1 We may from time to time provide interactive services on the Site, including, without limitation:
8.1.1 comments
8.1.2 message to message email
(the "Interactive Services");
8.1.3 social networking facilities.
8.2 Where we do provide any Interactive Services, we will provide clear information to you about the kind of service offered, if it is moderated and what form of moderation is used (including whether it is human or technical).
8.3 Users must be between the ages of [8 to 18] inclusive to create a profile or make Contributions to the Site.
8.4 We will do our best to assess any possible risks for users (and in particular, for children) from third parties when they use any Interactive Services provided on the Site, and we will decide in each case whether it is appropriate to use moderation of the relevant service (including what kind of moderation to use) in the light of those risks. [However, we are under no obligation to oversee, monitor or moderate any Interactive Services we provide on the Site, and we expressly exclude our liability for any loss or damage arising from the use of any Interactive Services by a user in contravention of our content standards, whether the service is moderated or not.]
8.5 When using any of our Interactive Services children must get the consent of their parent or guardian. We advise parents who permit their children to use the Interactive Services that it is important that they communicate with their children about their safety online and potential risks as moderation is not foolproof.
8.6 Where we do moderate any Interactive Services, we will normally provide you with a means of contacting the moderator, should a concern or difficulty arise.
9. CONTENT STANDARDS
9.1 These content standards apply to any and all Contributions, and to any Interactive Services associated with it.
9.2 You must comply with the spirit of the following standards as well as the letter. The standards apply to each part of any Contribution as well as to its whole.
9.3 Contributions must:
9.3.1 be accurate (where they state facts including information you provide to us about yourself in your Profile);
9.3.2 be genuinely held (where they state opinions); and
9.3.3 comply with applicable laws in the UK and in any country from which the Contributions are posted.
9.4 Contributions must not:
9.4.1 contain any material which is defamatory;
9.4.2 contain any material which is obscene, offensive, vulgar, hateful or inflammatory;
9.4.3 promote sexually explicit material;
9.4.4 promote violence;
9.4.5 promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;
9.4.6 infringe any right including (but not limited to) copyright, database right or trade mark of any other person;
9.4.7 be likely to deceive any person;
9.4.8 be made in breach of any law or regulation, whether criminal, tortious or otherwise;
9.4.9 promote any illegal activity;
9.4.10 be threatening, abuse or invade another's privacy, or cause annoyance, inconvenience or needless anxiety;
9.4.11 be likely to harass, upset, embarrass, alarm or annoy any other person ;
9.4.12 be used to impersonate any person, or to misrepresent your identity or affiliation with any person;
9.4.13 give the impression that they emanate from us, if this is not the case; or
9.4.14 advocate, promote or assist any unlawful act such as (by way of example only) copyright infringement or computer misuse.
9.4.15 bring the Site, NDCS or its name into disrepute.
9.4.16 send unsolicited bulk email or spam to other users
9.5 If any of these rules are broken by you or other users or if you have any other concerns about materials posted on the Site, please write to us at webteam@ndcs.org.uk immediately.
10. SUSPENSION AND TERMINATION
10.1 We will determine, in our discretion, whether there has been a breach of these terms of use through your use of the Site. When a breach of these terms of use has occurred, we may take such action as we deem appropriate.
10.2 Failure to comply with these terms of use constitutes a material breach of these terms of use and may result in our taking all or any of the following actions:
10.2.1 immediate, temporary or permanent withdrawal of your right to use the Site;
10.2.2 immediate, temporary or permanent removal of any posting or material uploaded by you to the Site;
10.2.3 issue of a warning to you or demand that you amend or delete material which you have posted on the Site;
10.2.4 legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach;
10.2.5 further legal action against you; or
10.2.6 disclosure of such information to law enforcement authorities as we reasonably feel is necessary.
10.3 We exclude liability for actions taken in response to breaches of these terms of use. The responses described in these Terms of use are not limited, and we may take any other action we reasonably deem appropriate.
11. USE OF YOUR CONTRIBUTIONS TO SITE
11.1 Any Contribution you post or transmit to the Site may be used by us for any purpose, including but not limited to reproduction, disclosure, transmission, publication and broadcasting. We are free to use any ideas, concepts, know-how, or techniques contained in any communication you send to the Site for any purpose whatsoever.
11.2 If your access to the Site is terminated or suspended for any reason, you must not attempt to create a new Profile (including re-registering with new log-in details), access the Site or contact any other user of the Site without our prior consent.
11.3 You are wholly responsible for all Contributions posted on the Site by you or any materials (including but not limited to emails) sent by you in connection to the Site.
11.4 You grant other users of the Site a non-exclusive licence to view the Contributions you post or upload to the Site, subject to these Terms and Conditions.
12. INFORMATION ABOUT YOU AND YOUR VISITS TO THE SITE
We process information about you in accordance with our privacy policy. By using the Site, you consent to such processing and you warrant that all data provided by you is accurate.
13. VIRUSES, HACKING AND OTHER OFFENCES
13.1 You must not attack the Site via a denial-of-service attack or a distributed denial-of service attack.
13.2 By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use the Site will cease immediately.
13.3 We will not be liable for any loss or damage caused by a distributed denial-of-service attack.
14. LINKING TO THE SITE
14.1.1 You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.
14.1.2 You must not establish a link from any website that is not owned by you.
14.1.3 The Site must not be framed on any other site, nor may you create a link to any part of the Site other than the home page. We reserve the right to withdraw linking permission without notice. If you wish to make any use of material on the Site other than that set out above, please address your request to webteam@ndcs.org.uk.
15. LINKS FROM THE SITE
Where the Site contains links to other sites and resources provided by third parties, these links are provided for your information only. We have no control over the contents or availability of those sites or any products or services offered through such sites. We do not endorse and accept no responsibility for them or for any loss or damage that may arise from your use of them. Any concerns regarding an external link should be directed to webteam@ndcs.org.uk immediately.
16. JURISDICTION AND APPLICABLE LAW
16.1 The English courts will have [non-]exclusive jurisdiction over any claim arising from, or related to, a visit to the Site.
16.2 These terms of use and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales.
16.3 We have used reasonable endeavours to ensure that the Site complies with UK laws, but cannot ensure that it is appropriate or available for use in every territory outside the UK. Those who visit the Site from other territories are responsible for compliance with all applicable laws. If use of the Site and/or viewing of it, or use of any material or content on the Site or services, are contrary to or infringe any applicable law in your jurisdiction(s), you are not authorised to view or use the Site and you must exit immediately.

18.3 If any provision or term of these terms of use shall become or be declared illegal, invalid or unenforceable for any reason whatsoever, such term or provision shall be separated from the other terms of use and shall be deemed to be deleted from them.

18.5 A notice will be deemed received when an e-mail is received in full (or else on the next business day if it is received on a weekend or a public holiday in the place of receipt).

Do we use 'Cookies' ?
